TANGO the American Staffordshire terrier may be returning home to the Gold Coast after six years away from his loving family but the dog fight is not over.

Tango's owners John Mokomoko and Kylie Chivers plan to sue the Gold Coast City Council to recover the $500,000 they have spent proving their dog's breed.

Tango has lived in a kennel in Northern NSW since the council identified him as a pit bull in 2004.

The ruling meant the dog was automatically deemed dangerous and required it to be euthanased.

The couple, who had vet certification and other evidence proving Tango was an AmStaff has spent up to $500,000 on kennel fees, visitation and fighting the ruling in court.

Council froze AmStaff registrations in April after the Supreme Court ruled they were the same breed as outlawed American pitbull terriers.

But the State Government in July amended the Animal Management (Cats and Dogs) Act 2008 to clarify that while they came from the same breeding stock, AmStaffs were not classified as restricted dogs.

Mr Mokomoko yesterday said had been asked to produce a vet certificate to prove Tango was an AmStaff before it could be registered.

He said council had held the certificate and other evidence of Tango's breed for years and he felt the request was another stalling process.

''The Gold Coast City Council now want a vet certificate or pedigree papers or something else.

''A Supreme Court judge has said it, what's the point in going to the Supreme Court if they don't want to accept the ruling?

''We've spent over $40,000 in kennel fees alone and we didn't break the law.''

Ms Chivers said she believed if council admitted they were wrong in banishing Tango from the Coast, it would open them to litigation from other AmStaff owners.

She said they would be attempting to recover costs from Council for the botched banishment.

''They owe us... for six years AmStaffs were allowed to live here, he was registered, desexed, microchipped.

''They really singled us out.''

The council's animal management chief Cr Bob La Castra said AmStaff owners were now free to register their dogs after providing a vet certificate.

''Tango will not be treated any differently to anyone else.

''As the court has already ruled their dog is an AmStaff, they may not have to produce one (a certificate), but if they do, I can't see what the problem is.''

A council spokesman said council would defend any legal action launched against them as they were acting under the law of the day.

''Council does not accept that any enforcement action taken by council to date under the local law exposes it to any claim for compensation.''

Just had this emailed to me

PORT CHARLOTTE, Fla. -- The wandering 65-pound Pit Bull mix might have seemed menacing to some passerby, but one woman will always remember him as her "guardian angel."

The dog, which authorities think is lost and not a stray, successfully thwarted a robbery attack on a mother and her 2-year-old son, who were held at knifepoint Monday afternoon.

The Florida woman, who has been identified by authorities simply as "Angela," was leaving a playground with her toddler son in Port Charlotte when a man approached her in the parking lot with a knife and told her not to make any noise or sudden movements.

Angela didn't have to do either to protect herself and her child -- a dog mysteriously ran to the scene and charged the man, who quickly fled.

"I don't think the dog physically attacked the man, but he went at him and was showing signs of aggression, just baring his teeth and growling and barking. It was clear he was trying to defend this woman,"

"I don't know what this man's intentions were, but it is very possible this dog saved her life."

The exceptional part of the story, Jones said, is that the dog had never met or even seen the people it quickly jumped to defend.

"You hear about family dogs protecting their owners, but this dog had nothing to do with this woman or her kid," Jones said. "He was like her guardian angel."

After the alleged thief ran away, Angela quickly placed her son, Jordan, in the car and tried to drive off. Before she could, though, the dog jumped into her backseat, waiting with her for the police and animal control officers to arrive at the scene.

The dog was transported to a local shelter and if his owners don't step forward within five days, Jones said, Angela and her family plan to adopt the savior she named "Angel."

Donations in excess of $76,00.00 lead me to belive that there is hope for the perception and the future of the breed. You know that there had to be an awful lot of 5 and 10.00 donations to achieve that amount. Too bad it takes a tragedy to get people to be aware and generous. Bob

i agree. if all the people that would fight BSL after it has hit them would fight before. then there is a good chance we could have stamped it out before it hit
